1. About these terms
These Terms of Service ("Terms") govern use of the AnytimeInterview platform ("Platform"), operated by Social Club Ventures Pty Ltd (ABN 77 605 099 584) of L2, 15 Mayneview Street, Milton QLD 4064, Australia ("we", "us", "our"). By creating an account, purchasing credits or a subscription, or using the Platform, you agree to these Terms. If you use the Platform on behalf of an organisation, you warrant you are authorised to bind that organisation, and "Customer" and "you" refer to it.
2. The service
The Platform conducts live, AI-powered video interviews with candidates on the Customer's behalf. An AI interviewer asks questions, generates dynamic follow-ups in real time, and produces transcripts, competency scores, and assessment summaries against criteria the Customer configures. How personal information is handled is described in our Privacy Policy, which forms part of these Terms.
3. Accounts
You must provide accurate account information and keep credentials secure. You are responsible for activity under your account. We may suspend accounts that breach these Terms or present a security risk.
4. Candidates
Candidates use the Platform at the invitation of a Customer and are not charged. Before an interview begins, candidates are asked to consent to recording and AI processing as described in the Privacy Policy. Candidates with questions about a hiring process or decision should contact the hiring organisation.
5. Customer obligations
The Customer must:
- use the Platform only for lawful recruitment purposes and comply with all applicable laws, including anti-discrimination and employment law in each relevant jurisdiction;
- ensure candidates are properly informed and that a lawful basis exists for processing their personal information, including any notice or consent the Customer is required to obtain in addition to the consent the Platform captures;
- not configure interviews to solicit sensitive information (e.g. health, ethnicity, political opinions) or use the Platform to unlawfully discriminate;
- treat AI-generated scores and summaries as decision support only. Hiring decisions are the Customer's, made by people. The Customer must not represent to candidates that decisions are made by the Platform.
6. AI outputs
AI-generated content (follow-up questions, transcripts, scores, summaries) is produced by machine-learning systems and may contain errors, omissions, or transcription inaccuracies. We do not warrant that AI outputs are accurate, complete, or suitable as the sole basis for any decision. The Customer is responsible for reviewing outputs and for all decisions made using them.
7. Credits, subscriptions, and payment
- Credit packs are prepaid interview credits, purchased at the prices displayed at checkout. Credits are consumed per interview conducted and are non-transferable.
- Subscriptions are billed in advance for each billing period and continue until cancelled. Cancellation takes effect at the end of the current billing period.
- Payments are processed by Stripe. Prices are in Australian dollars and, where applicable, inclusive of GST unless stated otherwise.
- Except as required by law (including the Australian Consumer Law), payments are non-refundable and unused credits are not redeemed for cash.
- We may change pricing with reasonable notice; changes apply from your next purchase or billing period.
8. Acceptable use
You must not: interfere with or disrupt the Platform; attempt unauthorised access; reverse engineer the Platform; use it to develop a competing service; upload malicious code; record or process individuals without a lawful basis; or resell access except under a written agreement with us.
9. Intellectual property
We own the Platform and all associated intellectual property. The Customer owns its role configurations and competency criteria, and ... as between the Customer and us ... the interview recordings, transcripts, and assessments generated for it, subject to candidates' rights under privacy law. We are granted a licence to host and process this content solely to provide the service. We do not use it to train AI models, as described in the Privacy Policy.
10. Data and privacy
Our collection and handling of personal information is governed by the Privacy Policy. The Customer is responsible for its own privacy compliance as the party directing candidate processing. On termination, Customer data is handled per the retention terms in the Privacy Policy.
11. Availability and changes
We aim for high availability but do not guarantee uninterrupted service. We may modify or improve Platform features, and will not materially degrade core functionality mid-subscription without notice.
12. Liability
Nothing in these Terms excludes rights that cannot be excluded under law, including consumer guarantees under the Australian Consumer Law. Where we are permitted to limit our liability for breach of a non-excludable guarantee, it is limited to resupply of the services or the cost of resupply. Otherwise, to the maximum extent permitted by law: we are not liable for indirect or consequential loss, loss of profits, or loss of data; our total aggregate liability is limited to the amounts the Customer paid us in the 12 months before the event giving rise to the claim; and we are not liable for hiring decisions, which remain the Customer's responsibility.
13. Indemnity
The Customer indemnifies us against claims arising from its breach of clause 5, its hiring decisions, or its unlawful use of the Platform.
14. Termination
Either party may terminate for material breach not remedied within 14 days of notice. We may suspend or terminate immediately for serious misuse or legal risk. Clauses that by nature survive (IP, liability, indemnity) survive termination.
15. General
These Terms are governed by the laws of Queensland, Australia, and the parties submit to the non-exclusive jurisdiction of its courts. If a clause is unenforceable it is severed; the rest remains. These Terms and the Privacy Policy are the entire agreement unless a separate written agreement exists between us.
